Once the customs checks, they will check and detain the goods, and require the customer to provide relevant proof that the ingredients of the goods do not contain Xinjiang cotton before release.”

According to foreign media, the US authorities are expected to take effect on June 21 under a labor Law on the Prevention of Forced Uyghur labor, and will ban imports from China’s Xinjiang region in accordance with the law unless the latter can provide evidence that their products do not involve forced labor. In other words, products manufactured in Xinjiang are presumed to use forced labor and are banned from import unless the U.S. government certifies them as free from forced labor. However, the threshold for obtaining certification without forced labor is very high. It is not only required to provide clear and convincing evidence that there is no forced labor component in the entire supply chain of imported goods, but also approved by the Customs commissioner and reported to the Congress, which shows how difficult it is to obtain.

In addition, U.S. Customs and Border Protection may impose penalties on importers if evidence presented is determined to be fraudulent. In addition, the executive director said importers have the option of transshipment of related goods suspected of being prohibited back to their country of origin.

1. Cotton growth needs a very long sunshine time, because in the fruit period of cotton if the long cloudy day will cause rotten fruit, insect infestation, adverse cotton growth, will reduce production or no harvest grains. Xinjiang is dry with little rain, which can reach more than 18 hours of light.

2. Cotton growth needs sufficient heat resources and precipitation or irrigation conditions during the growing period. Xinjiang is an arid region with long sunshine duration, long frost-free period and high active accumulated temperature, which is particularly suitable for cotton growth climate conditions. What materials are needed for export?

1. Certificate of origin: the purchase order information and the address of the factory producing the goods should be indicated;

2. The customer issues a guarantee stating that the export goods do not contain Xinjiang cotton;

5. Purchase order and invoice for cotton cloth;

6. Other relevant documents required by customs

If the customer fails to provide the above information and the goods are eventually detained by the customs, the costs and risks arising therefrom shall be borne by the customer.
